Child Custody and Child Support
In Illinois, the courts follow the best interest of the child standard when making custody decisions. Typical arrangements involve joint legal custody, in which one parent is named the custodial parent, meaning the child will live mainly with that parent. The other parent receives visitation. In joint legal custody, both parents have authority to make decisions about their child's religion, education, medical care and welfare. It is important to note that the Illinois Supreme Court has ruled that if both parents can't reach a resolution for child custody, the court will order both parties into mediation.
Our state uses a statutory floor to determine child support. Basically, one child equals 20 percent of a parent's income. It is important to consult with a qualified attorney for support issues.
Maintenance and Property Division
In Illinois, assets and debts are divided using equitable distribution guidelines. That doesn't mean each spouse will receive 50 percent. Our decades of experience and familiarity with the agricultural industry enable our lawyers to determine real estate, small business and commercial real estate values consistent with the court. We can discuss your situation and provide informed guidance.
Spousal support, or maintenance, is determined by the length of your marriage and other factors. The court will review the earning potential of both parties, sacrifices each party made during the marriage and other factors to decide if maintenance is warranted, as well as the amount and duration of support.
Our extensive family law practice extends beyond divorce to include the following:
- Legal separation
- Adoptions
- Paternity actions
- Prenuptial agreements
- Postnuptial agreements
